Terms of Use

The short version. personAIity writes fictional people and lets you talk to them. Use it for that. Do not flood it, do not use it to be cruel, and do not treat what a persona says as fact or advice. If you break those, we may close your account.

These terms are between you and Popps Technologies ("we", "us") and cover the personAIity app and the service behind it. Using the app means accepting them. If you do not, do not use it.

Your account

The app creates an anonymous account on first launch so your conversations stay yours. Creating a persona requires signing in with Apple. You are responsible for what happens under your account. One person, one account: do not create accounts to get round a limit or a suspension.

You can sign out or delete your account at any time from the account screen. Deleting is immediate and permanent.

Credits and payment

How the service works, and its limits

A persona is written by a language model from your description and reviewed by a person before it exists. That means two things worth being plain about: it takes time -- usually minutes, occasionally longer -- and we may decline a request. If we decline one, we say why and it costs you nothing.

We may also change, pause or discontinue parts of the service. If we discontinue it altogether, we will say so with reasonable notice and honour unspent credits as best we can.

Using it as intended

The service exists for one thing: writing fictional people and having conversations with them. The following are not that, and doing them may cost you your access.

Flooding the service

Every reply and every persona costs real computing time, and persona requests are fulfilled by a person. Do not automate the app, script it, or drive it faster than somebody actually using it would.

That applies to conversation as much as to requests. Sending the same word, letter, sentence or question over and over, hammering send to see what happens, or otherwise generating replies you are not reading, is flooding — it costs us the same as a real conversation and gives you nothing. Talk to a persona at the speed of talking to somebody.

We may rate-limit an account that does this before we do anything else. Persistent flooding is the clearest case for suspension there is, because it takes the service away from everybody else.

Cruelty, violence and obscenity

Do not use personas to produce content that is cruel, violent, sexually explicit, hateful, or degrading towards any person or group. A single reply that strays is usually the model's fault and we would rather you reported it. Repeated attempts to steer personas into that material are yours, and may lead to suspension or closure of your account. We look at reported conversations, and at accounts that generate a lot of them.

Real people

Do not ask for a persona of a real, identifiable person, and do not use one to impersonate anybody. We refuse those requests when we spot them.

Anything unlawful

Do not use the service to break the law, to produce material involving minors, to harass, or to attempt to extract, attack or reverse-engineer the systems behind it.

What we do about it

Depending on what happened and whether it has happened before, we may refuse a request, remove a persona, suspend an account, or close one. We aim to warn before closing an account, except where the conduct is serious enough that a warning would be beside the point -- unlawful material, or a deliberate attack on the service.

If we close your account for breaking these terms, unspent credits are not refunded. If we close it for any other reason, or you simply ask us to, tell us and we will do what is fair.

Think we got it wrong? Email us. A person will read it.

What a persona is, and is not

Personas are fiction. They are written by a language model, they are confidently wrong sometimes, and they do not know anything about the real world beyond what they were written with and the time and weather where they live.

Nothing a persona says is advice. Not medical, legal, financial, psychological or safety advice, whoever the persona is written to be. Do not rely on it, and do not use the app as a substitute for a professional or for a person who cares about you. If you are in crisis, contact your local emergency services or a crisis line.

Your content

What you write stays yours. You give us permission to store it and to send it to the model provider that produces replies, because that is how the service functions -- see the Privacy Policy. Personas we write for you are yours to use in the app; we may keep them available to you until you delete them.

Do not submit anything you do not have the right to submit.

Reporting

The chat screen's menu has Report last reply. It sends us the message. We read what comes in, and it is the fastest way to get a bad persona rewritten or removed.

No warranty, and the limit of what we owe

The service is provided as it is. We do not promise it will be available without interruption, that a persona will be any good, or that a reply will be accurate.

To the extent the law allows, our total liability to you for anything arising out of the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential losses. Nothing here limits liability that cannot be limited by law.

Changes

We may update these terms. The date at the top changes, and if a change materially affects your rights we will say so in the app. Continuing to use the service after that means accepting the new terms.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Nothing here removes any right you have under the consumer law of the country you live in.
